California Rule of Court section 1.100 requires that all California courts ensure that persons with disabilities have equal and full access to the judicial system, including court proceedings, services, programs and activities. Service Dogs Service animals are permitted in the courthouse subject to federal ADA regulations. The ADA defines a “service animal” as any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other disability. The work or tasks performed by a service animal must be directly related to the handler’s disability. Dogs whose sole function is “the provision of emotional support, well-being, comfort, or companionship” are not considered service dogs under the ADA. The Department of Justice published revised final regulations implementing the Americans with Disabilities Act (ADA) for title II (State and local government services) and title III (public accommodations and commercial facilities) on September 15, 2010, in the Federal Register. These requirements, or rules, clarify and refine issues that have arisen over the past 20 years and contain new, and updated, requirements, including 2010 Standards for Accessible Design (2010 Standards).
